What happens next

Local Boards will present their feedback to the Bylaw Panel at a public session on Tuesday 19 October 2021, from 9:30am to 12:30pm.

All of the feedback will then be considered by the Bylaw Panel at a public deliberations session on Wednesday 20 October 2021, 9:00am to 11:30am.

Due to COVID-19 restrictions, these sessions will take place online using Microsoft Teams. There will not be an opportunity to have your say at either meeting. If you would like to observe the meetings please email julie.mckee@aucklandcouncil.govt.nz for the link.

The Panel will use the feedback to make recommendations on the proposal to the Governing Body. The Governing Body will make a final decision on the proposed new Public Trading, Events and Filming Bylaw 2022 at its meeting on 25 November 2021.


About this proposed bylaw

Every day, various trading activities, events, and filming occur in public places controlled by Auckland Council.

These activities increase the vibrancy and appeal of public places such as streets, footpaths, local parks and civic spaces by enhancing amenities and delivering social and economic benefits.

However, they also may increase the risk of:

  • preventable collisions
  • accidents
  • injuries
  • obstructions
  • nuisance
  • misuse of council-controlled public places.

How we protect you

We make rules for trading, events and filming in public places we control.

These include:

  • markets
  • stalls
  • mobile shops
  • outdoor dining
  • hire of micro-mobility devices and recreational equipment
  • fundraising
  • promotions
  • display of goods
  • street performance
  • busking
  • pavement art.

These activities must either be approved or comply with conditions of use of a council-controlled public space.

About the current bylaw

The current Trading and Events in Public Places Bylaw 2015 will expire in February 2022.

We are proposing a new Public Trading, Events and Filming Bylaw 2022 that will minimise:

  • public safety risks
  • nuisance
  • misuse of council-controlled public places
  • be easier to read and understand.

What we are proposing

The main proposals are to:

  • continue to regulate trading, events and filming in a similar way to the current bylaw
  • set specific rules for rental micro-mobility devices
  • clarify activities that need approval, are allowed subject to conditions, or are not addressed in the bylaw
  • update the title, structure, format, definitions, and wording of the bylaw.
