What we are proposing
Under Section 138 of the Local Government Act 2002, we are notifying our intention to grant a new commercial lease over the building at 39 Birkenhead Avenue for the purpose of operating a licensed restaurant.
About the site
The land is legally described as 'Part Allotment 57 Parish of Takapuna' as it appears in Record of Title NA8D/1192 held by Auckland Council.
The proposed lease is for the 169 square metre building which includes a balcony and covered front dining area.
Term of lease
If the lease is granted, the proposed new commercial lease is for a term of six years from 1 August 2023 to LMY Limited. There is a further right of renewal of six years. There will be no change to the use of the site.
What we want your feedback on
We want to know if you object to us granting this new commercial lease, and if so, why?
Any information provided is subject to the Local Government Official Information and Meetings Act 1987 and may be released by us under that act.
Any one who writes a submission should state if the whole or any part of the objection is to be kept confidential.
How you can have your say
Anyone who wants make an objection or submission about this commercial lease must lodge this in writing by 5pm on 18 May 2023.
